Acceptance of These Terms

By accessing or using MosquitoBay.org, you agree to these Terms and Conditions and the policies incorporated by reference. If you do not agree, do not use the site.

You must use the site in accordance with applicable law. If you use the site on behalf of an organization, you represent that you have authority to bind that organization to these terms.

What the Site Provides

MosquitoBay.org provides general visitor information about Mosquito Bay, Vieques, Puerto Rico, including travel planning, moon phases, transport, tours, booking considerations, costs, and related destination topics.

The site is an independent editorial resource. It is not affiliated with or endorsed by the government of Puerto Rico, the municipality of Vieques, the U.S. Fish and Wildlife Service, a tour operator, or a booking platform unless a relationship is expressly stated.

Acceptable Use

You may use the site for lawful personal, informational, and travel-planning purposes. You may not:

• interfere with site operation, security, availability, or other visitors
• attempt unauthorized access to systems, accounts, code, or data
• introduce malware, automated abuse, scraping that creates unreasonable load, or deceptive traffic
• copy, republish, sell, or exploit protected site content beyond what applicable law permits
• misrepresent affiliation with MosquitoBay.org or use the site to deceive others

Third-Party Bookings

The site may link to tour operators, marketplaces such as Viator, transport providers, accommodations, maps, and other independent services. When you select an external link, you leave MosquitoBay.org and deal directly with that provider.

The provider is solely responsible for:

• availability, prices, taxes, fees, currency conversion, and checkout terms
• booking confirmation, payment processing, cancellations, changes, refunds, and support
• tour operation, guides, equipment, traveler restrictions, accessibility, and safety procedures
• its own descriptions, warranties, privacy policy, and terms

MosquitoBay.org is not a party to the booking agreement and cannot change or enforce a provider’s reservation. Direct booking disputes to the provider named in the listing or confirmation.

Information Can Change

Reasonable efforts are made to research and update site content, but travel information can change without notice and errors can occur.

Verify time-sensitive information with the relevant official source or service provider before relying on it or making non-refundable arrangements. Site tools, calendars, estimates, and comparisons are planning aids, not live inventory or guarantees.

Bioluminescence Is Not Guaranteed

Mosquito Bay is a natural ecosystem. The apparent brightness and visibility of bioluminescence can vary with biological activity, moonlight, moon position, clouds, rain, wind, water movement, tour timing, viewing conditions, and how long a visitor’s eyes adapt to darkness.

Moon-phase calculations and contrast labels estimate lunar conditions only. They do not predict biological brightness, weather, water quality, safety, or the exact experience on a given tour.

The site does not guarantee that bioluminescence will be visible, that it will match photographs or descriptions, or that a tour will operate on a particular date.

Travel, Health, and Safety

Travel and outdoor activities involve risks, including weather, transport disruption, darkness, uneven surfaces, water, wildlife, physical exertion, equipment use, and delayed access to assistance.

• Follow current instructions from authorities, operators, guides, and transport providers.
• Review traveler eligibility, health, mobility, age, and weight requirements before booking.
• Use qualified professional advice for medical, legal, financial, safety, or accessibility decisions.
• Make independent judgments about conditions and whether an activity is appropriate for you.

Images and AI-Assisted Visuals

Photographs, graphics, maps, mockups, and other visual content are used for information and illustration. Some visuals may be cropped, color-adjusted, composited, digitally enhanced, or generated with artificial-intelligence tools.

Visuals may not show the exact brightness, moonlight, weather, water, equipment, group size, route, meeting point, or tour conditions you encounter. Images should not be treated as a promise or exact representation of a future experience.

Intellectual Property

Unless otherwise stated, original text, layout, branding, graphics, tools, and other site materials are protected by applicable copyright, trademark, and related laws.

You may view and print reasonable excerpts for personal, noncommercial use. You may not reproduce, republish, sell, license, scrape for commercial reuse, remove attribution, or create a competing compilation from substantial site content without permission, except where applicable law permits.

Third-party names, logos, photographs, trademarks, and other materials remain the property of their respective owners. Their appearance does not imply endorsement unless expressly stated.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied.

MosquitoBay.org does not warrant that the site will be uninterrupted, error-free, secure, complete, current, or suitable for a particular purpose. It does not warrant the accuracy, availability, quality, legality, safety, or performance of third-party services.

Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law. These limitations do not apply where prohibited or to liability that cannot legally be limited.

Changes and General Terms

Changes

These terms may be revised when the site, services, commercial relationships, or legal requirements change. The updated date at the top identifies the latest published version. Continued use after a revision means the revised terms apply from the stated effective date.

Severability

If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
